Trademark Registration in Saudi Arabia

Trademark registration in Saudi Arabia is the step that turns your business name and logo from an identity the market recognizes into a statutory right protected by law. At Alfkr Intellectual Property, we support business owners, companies and entrepreneurs at every stage: from the clearance search and class selection, to filing the application with the Saudi Authority for Intellectual Property (SAIP) and following it up until the certificate is issued, and then renewal, opposition and protecting the mark after registration.

This service is for you if you are preparing to open a restaurant or café, launch an online store or a new product, or if you have been trading under a name for years without registering it as a trademark. We serve creators, entrepreneurs and organizations of all sizes from our office in Riyadh. We work in both Arabic and English and can assist foreign companies and brand owners seeking protection in Saudi Arabia.

Why Do You Need Trademark Registration in Saudi Arabia?

The strong protection afforded by the GCC Trademark Law applied in the Kingdom, from the right to oppose similar marks to civil actions and criminal penalties, is in principle tied to a registered mark. Many business owners discover, after years of building a reputation, that someone else has already registered a similar name, and they are forced to rebrand or enter into a costly dispute. Recording a name in the Commercial Register is also no substitute for registering the trademark; each has its own legal regime and its own protection.

  • A statutory right to prevent others from registering an identical or similar mark for similar goods or services.
  • A basis for acting against counterfeiting before the competent authorities and the courts.
  • A business asset that can be licensed, assigned or valued in an investment or acquisition.
  • A foundation for extending protection outside the Kingdom, including international registration through the Madrid System.
  • The ability to request border measures with the Zakat, Tax and Customs Authority (ZATCA).

What We Offer

  • A comprehensive search for the mark you wish to register, inside and outside the Kingdom, followed by a legal and technical opinion on registration, or on amending the mark if necessary.
  • An analysis of the mark’s commercial and legal strength before you launch it or invest in it.
  • A technical and legal opinion on the most suitable class for your business under the Nice Classification, reducing the risk of refusal.
  • Accurately defining and describing the mark in accordance with the law, drafting the list of goods and services, and preparing and filing the application.
  • Following up the application and responding to the examiner’s observations and amendment requests within the statutory period.
  • Monitoring the mark during the publication period and responding to oppositions, as well as drafting oppositions against marks similar to yours.
  • Filing grievances and oppositions, or responding to them, before the competent body or court, and handling cancellation and revocation actions.
  • Tracking renewals and reminders to ensure uninterrupted protection.
  • Monitoring the market to detect unlawful use, and taking border measures with the Zakat, Tax and Customs Authority (ZATCA).

How We Work With You

  1. Initial consultation: We learn about your business and plans, and review the name or logo you want to protect.
  2. Clearance search: We search filed and registered marks by the Arabic and English name, by similar pronunciation and by translation, because confusing similarity is not limited to literal identity, and then give you a clear opinion.
  3. Class selection and drafting the specification: We identify the class or classes that cover your actual business and draft the list of goods or services.
  4. Filing the application: The application is filed on SAIP’s unified platform and, once the application fee is paid, it is referred for examination.
  5. Examination and SAIP’s decision: Examination ends in acceptance, acceptance subject to an amendment that must be made within 90 days, or a reasoned refusal, against which a grievance may be filed within 60 days of notification.
  6. Publication: After the publication fee is paid, the mark is published for 60 days, during which any interested party may file a written opposition; we monitor the mark and respond to any opposition.
  7. Certificate: If the publication period ends without opposition, the final invoice is issued and must be paid within 30 days of issue, after which the registration certificate is printed.
  8. After registration: We remind you of renewal deadlines and help you monitor the market and protect your mark.

Frequently Asked Questions

How much does it cost to register a trademark in Saudi Arabia?

The government fees published by the Saudi Authority for Intellectual Property total SAR 6,500: SAR 1,000 for the application, SAR 500 for publication, and SAR 5,000 for registration and issuance of the certificate. These fees are subject to change, and according to the fee schedule in the implementing regulations of the GCC Trademark Law they are listed for one mark in one class, so they apply per class; the final reference is the invoices issued by the platform. Our professional fees are separate from government fees, and we provide them in a detailed quotation on request.

How long does the trademark registration process take?

SAIP’s stated service time is 90 days. The process goes through examination, then publication of the mark for 60 days to receive oppositions, then payment of the final invoice within 30 days of its issue. The actual time may be longer if SAIP requests an amendment or an opposition is filed against the mark.

Do I need a firm or a trademark agent to register my trademark?

The law does not require it; the service is available to individuals and businesses directly on SAIP’s platform. If an agent files the application, the agent must be recorded in SAIP’s register of agents. The value of a specialist usually shows in the clearance search, class selection, drafting the list of goods and services, and responding to examination observations and oppositions within the statutory deadlines.

What should I do if my trademark application is refused?

A refusal decision must state its reasons, and a grievance may be filed against it within 60 days of the date of notification before the committee specified in the implementing regulations; the committee’s decision may then be challenged before the competent court within 60 days. Studying the grounds of refusal before filing a grievance helps determine the best route: a grievance, or amending the mark and refiling.

How do I oppose a trademark that is similar to mine?

An opposition is filed in writing within 60 days of the date the mark is published. SAIP then notifies the applicant with a copy of the opposition within 30 days, the applicant responds within 60 days, and SAIP then decides on the opposition. Its decision may be challenged before the competent court within 30 days. Missing the opposition period means that the route to cancellation after registration becomes a longer court action.

When do I renew my trademark, and what are the renewal fees?

The registration certificate protects your mark for ten years. The official renewal fee is SAR 5,500 if you renew during the last year of protection, and SAR 6,500 (confirm with SAIP before filing) during the six-month grace period after it expires, plus SAR 1,000 for publication of the renewal. If the grace period passes without renewal, the mark is removed from the register.
